Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the Pokerrrr mobile application. Mondraw Limited, ("us", "we", or "our") operates the Pokerrrr mobile application, website, social media pages and related services (collectively, the "Service").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. If you disagree with any part of the terms then you may not access the Service.

This software is for entertainment only. Using this software to gamble for money or anything of value is done so at your own risk. By registering for an Account or otherwise using the Service, you affirm that you (1) are 18 years or older, or 13 years or older and have your parent or guardian's consent to the Agreements, and (2) have the power to enter a binding contract with us and not be barred from doing so under any applicable laws. Purchases

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.

 

We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

 

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

 

Availability, Errors and Inaccuracies

We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other websites.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Contests and Promotions

Any contests or other promotions (collectively, "Promotions") made available through the Service may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

Price Changes

Mondraw Limited, in its sole discretion and at any time, may modify the purchase price for the in-store items. Any in-store item price changes will become effective at the end of the then-current purchase.

 

Refunds

As with most downloadable software products, items bought in our games (in-app purchases) are non-refundable. In rare cases, exceptions can be applied.

 

If the purchase was made on an Apple (iOS) device:

For purchases made on an iOS device, Mondraw Limited, is not able to handle refunds directly. Please visit Apple support and select the "Contact iTunes store support" link, then "Purchases, billing and redemption" and choose the option that fits you best.

 

If the purchase was made on a Google (Android) device:

For purchases made on a Google device, Mondraw Limited, is not able to handle refunds directly. Please visit Google Play Help and select “Get a refund on Google Play” underneath “Refunds & returns” drop-down and choose the option that fits you best. It may help to have your transaction ID ready (looks similar to this - GPA.1234-1234-1234-12345). Receipts for transactions have been emailed to you by Google after each purchase.

 

Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights. You agree that this license includes the right for us to make your Content available to other users of the Service, who may also use your Content subject to these Terms.

 

You represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

 

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

 

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

 

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

 

Copyright Policy

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes the copyright or other intellectual property infringement ("Infringement") of any person.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the Service, you must submit your notice in writing to the attention of "Copyright Infringement" of contact@pokerrrrapp.com and include in your notice a detailed description of the alleged Infringement.

 

You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any Content is infringing your copyright.

 

Intellectual Property

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Mondraw Limited, and its licensors. The Service is protected by copyright, trademark, and other laws of both the Taiwan and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Mondraw Limited.

Mondraw Limited, has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that Mondraw Limited, Ltd. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

 

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

 

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

 

Limitation Of Liability

In no event shall Mondraw Limited, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

 

Mondraw Limited, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

 

Governing Law

These Terms shall be governed and construed in accordance with the laws of Taiwan, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

 

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Mondraw Limited, ("us", "we", or "our") operates the Pokerrrr mobile application, website, social media pages and related services (collectively, the "Service"). This page informs you of our policies regarding the collection, use and disclosure of personal information when you use our Service, and the choices you have about your personal information.

By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Use.

1. INFORMATION THAT WE COLLECT

The categories of personal information we collect depend on the Service you use, and the requirements of applicable law.

1.1 Information You Provide Us Directly:

• Your name, email address, phone number, postal address, other contact information.

• Your player name, profile photo and other profile information.

• Your social network or third-party service user identification number (such as yourFacebook ID number).

• Other information you choose to give us, such as your age and date of birth, gender,physical location, occupation, time zone, and information you provide to request customer support or to participate in survey or promotional programs.

The personal information we will ask you to provide with information fields marked with an asterisk (*) or otherwise indicated as mandatory, are required in order to create your account, enable the Service, or comply with the law. You may also have the option to provide us with additional personal information in order to make your experience with our Services more personalized.

We do not knowingly collect or process special category data (i.e., personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data, data concerning health, or data concerning a natural person's sex life or sexual orientation). Where you provide such special category data via the Service, we may process such data on basis of our legitimate interest to enable the Service (see Section 2.1 below), and the exception that such data have been manifestly made public by you.

1.2 Information We Collect Automatically:

• Information about your account, such as an automatically created internal account ID.

• Information about your use of the Service, such as gameplay information (game session duration, hand history etc.), purchases (item purchased, transaction ID, etc.), and your interactions with other players inside the Service.

• Your IP address and mobile device identifiers (such as advertising ID).

• Information about your device, such as device name and operating system, browser type and language, internet service provider, and mobile carrier.

• Approximate location data, as derived from IP address.

• Information we collect with cookies and similar technologies (see section "Cookies and Similar Technologies" below).​

1.3 Information We Collect from Third Parties:

We may also cooperate with third parties, such as social networking sites, data analytics providers and advertising networks to collect supplementary information about you, such as:

• Information we receive if you link a third-party tool (such as Facebook) with the Service.

• Information from third-party platforms that our games run on, such as that needed toverify payment or to process an order.

• Demographic data, such as those used to determine the coarse location of your IP address.

• Information for advertising and analytics purposes, so we could improve our Service's functionality and provide you a better Service.

2.1 To Enable the Service

On basis of your contract with us and/or our legitimate interest to enable the Service, we collect and process necessary information to:

• Create your accounts and allow you to play our games and use our Service.

• Operate the Service.

• Verify and confirm purchases and payments.

• Provide and deliver products and services you request.

• Send you Service-related communications.​

2.2 To Improve the Service and Customize Your Service Experience

• Develop, maintain and update user profiles, game records and hand history.

• Provide in-game (in-app) leaderboard

• Provide social features as part of the Service.

• Customize your Service experience.

• Provide you promotional offers in the Service as well as in other websites and services

• Send you related information, such as updates, new products, features, security alerts,

  support messages, upgrade opportunities, contests and events of interest.

• Enable you to communicate with other players.

In accordance with the applicable law, we collect and process necessary information to:

• Comply with a legal obligation to which we are subject.

• Comply with a request by a competent court or other law enforcement authority.

• Enforce our Terms of Use.

2.4 To Show Personalized Advertisements

To show you personalized advertisements in the Service as well as in other websites and services (including email), we, on basis of your consent and/or legitimate interest to market the Service, collect and process necessary information to:

• Track the content you access in connection with the Service and your online behavior.

• Deliver, target and improve our advertising and the Service.

We may use remarketing/retargeting services provided by Facebook, Google, Snapchat, Twitter, Unity, etc., to advertise on third party platforms to you on basis of information collected upon your access to our Service. We, and our third-party vendors, use cookies and/or advertising identifiers to inform, optimize and serve ads based on your past access to our Service. Depending on the privacy settings on your device, the information collection may initiate immediately when you open our application.

 

Our use of remarking/retargeting services will always be in compliance with the privacy

2.5 To Keep the Service Safe and Fair

Ensuring a safe, smooth and trusted environment in the Service is a top priority for us. In order to keep the Service and its social features safe and fair, to fight fraud and other illegal activities, we have a legitimate interest to collect and process necessary information to:

• Analyze and monitor use of the Service and its social features.

• Moderate chats either automatically or manually.

• Take action against fraudulent or misbehaving users.

2.6 Additional Purposes with Your Consent

Also, we may keep your in-app purchase history and email correspondence with us for a few years after you have ceased using the Service, if this is necessary for us to fulfill a legal obligation or to establish, exercise or defend a legal claim

As social features are a component of our Service, other players and users may, for example, see your profile data, in-game activities and read the messages you have posted.

We employ third-party services to facilitate our Service, to provide the Service on our behalf, or to help us improve the Service. These third-party service providers may process your information, only at and according to our instructions, for purposes of Service-related tasks, such as hosting, user support, advertising, analytics and fraud prevention. 4.3 Public Authorities, Other Companies and Organizations

In accordance with the applicable law, we may provide your information to public authorities. In addition, we may share your information with other companies and organizations in order to combat fraud and illegal activity. We may also disclose your information based on your consent, or to protect the rights, property or safety of us, our players or others.

4.4 Mergers and Acquisitions

If we are involved in a merger, acquisition or asset sale, your personal information may be transferred as a portion of our assets. We will provide notice before your personal information is transferred and becomes subject to a different privacy policy.

The security of your personal information is important to us. We will respond to all requests in accordance with applicable laws and within a reasonable timeframe. With your consent we may use your personal information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you.
